Day Trading with Fidelity: Rules, Pros and Cons

You can day trade at Fidelity with less than $25,000, because Fidelity says the pattern day trader rules were replaced on June 4, 2026, and that it no longer counts day trades on margin accounts. Margin accounts still need at least $2,000 in equity. Online U.S. stock and ETF trades cost $0 in commission, and options cost $0.65 per contract. Some of Fidelity's older help pages still describe the old rule, so call the firm if a page you read disagrees.
Fidelity's day trading rules
| Rule | Margin account | Cash account |
|---|---|---|
| Pattern day trader label | Removed, according to Fidelity | Never applied |
| Minimum equity | $2,000 | No regulatory minimum |
| What limits your trades | Intraday margin | Settled funds |
| Main risk from breaking the limit | Intraday margin deficit | Good faith or free-riding violation |
| Short selling | Allowed | Not available |
Fidelity says that exceeding your intraday exchange surplus or ending the day in an exchange call may result in an intraday margin deficit. FINRA's guidance says you must cover a deficit as promptly as possible, and that repeated failure can freeze margin trading for 90 days or until the deficit is covered. Read our guide to what replaced the pattern day trader rule for a worked example.
In a cash account you can trade only with settled funds. Most stock trades settle on T+1, the next business day, so if you buy and sell a $1,000 position on Monday, that $1,000 is available again on Tuesday. Fidelity has a separate guide to avoiding cash account violations.
What day trading at Fidelity costs
These figures come from Fidelity's commission and margin schedule, which showed a base margin rate effective September 18, 2026.
| Cost | Fidelity's published figure |
|---|---|
| Online U.S. stock or ETF trade | $0 commission |
| Online options trade | $0.65 per contract, plus an options regulatory fee |
| Margin rate on $0 to $24,999 | 12.075% |
| Margin rate on $250,000 to $499,999 | 10.325% |
The options fee is the one that adds up for active traders. A day trader who buys and sells 10 contracts once a day pays for 20 contracts per day, which is $13 per day or about $3,263 over 251 trading days. You can compare your costs against your results with the expectancy calculator.
Fidelity's trading platforms
Fidelity's site lists Fidelity Trader+ and Fidelity Trader+ Web as its active trading platforms, and you should confirm the current features there. We could not read the product page directly, so we have left out feature counts. Our Level 2 guide can help you decide what you need from a platform.
Pros and cons of day trading with Fidelity
The main advantages are zero commissions on stocks and ETFs and the fact that the firm has already moved past the old $25,000 rule. A large, established broker also suits traders who keep long-term money in the same place, since everything sits in one account.
The main drawback is cost for specific styles. Options traders pay $0.65 per contract where Webull's pricing page shows no commission on most U.S.-listed options, and the 12.075% margin rate on small balances is high enough to matter on loans carried overnight.
How to start day trading on Fidelity
Open a brokerage account and decide whether you need margin at all, because a cash account removes margin deficits entirely. If you apply for margin, you will need at least $2,000 in equity. Then practice your rules on a paper trading platform, because the SEC warns that day traders typically suffer severe financial losses in their first months. Size every trade from your stop with the position size calculator.
